Updated press release 10-31-16 On October 30th at 5:47 p.m., officers responded to a burglary in progress at 1903 Mississippi. The caller advised that there was an intruder inside the residence who had a gun. The caller also asked for police to hurry, then hung up. As officers arrived at the scene they observed a female exit the residence, being followed by a male. As the two exited the residence, the male displayed a handgun and fired several times at the female, striking and killing her. One of the responding officers immediately returned fire, grazing the male, who then surrendered and was taken into custody. During the preliminary investigation detectives learned that the intruder was actually 39 year old Elrey Gonzalez, the estranged husband of the victim, 41 year old Elva Gonzalez, both of Baytown. Detectives also learned that two of Elva’s children were inside the residence at the time of the incident, a 16 year old female and a 21 year old male, both were unharmed. During the course of the investigation detectives learned that the couple had separated approximately three weeks earlier and Mr. Gonzalez was upset with Elva over the separation. Mr. Gonzalez showed up at the residence and while there he displayed a handgun and threatened to shoot Elva and her children if Elva did not leave with him. At some point Mr. Gonzalez forced Elva out of the residence, into the front yard, at which time he shot and killed her. Detectives interviewed Mr. Gonzalez and he has confessed to his involvement in the Homicide of Elva Gonzalez. Charges of Capital Murder have been accepted on Mr. Gonzalez through the Harris County District Attorney’s Office. The Officer who returned fire at Mr. Gonzalez has been placed on mandatory administrative leave for three days, as is customary with officer involved shootings.
